Slice of Life Portrait Shoot Terms and Conditions
Copyright Policy
The copyright in all photographic works resulting from the booking remains the property of Duo Photography Ltd. The client acknowledges that the purpose of the creation of the photographic works includes the right of the Photographer to:

enter the photographic works into photographic competitions or awards and for their use in any material published in connection with promoting those competitions or awards; and;
-
advertise or otherwise promote the Photographer's work; and
-
submit the photographic works for display at art galleries or other premises and;
-
use the photographic works for any other purpose within the photographers business activities.
Show and Tell Clause

Because this booking and portrait shoot takes considerable time and care, the client understands and agrees to partake in a “show and tell” presentation of the works within 60 days of the portrait shoot dated above. The purpose of which is to allow the client to make selections of the works and an opportunity for Duo photography to showcase all our printing and sizing and package options.

It is also understood and agreed that although this will be a “no high pressure selling” process and there is no obligation to purchase anything it is understood that due to file storage limitations and risks on the company, selections and choices have to be made at the time of the show and tell presentation.

Any postage and packaging costs are not included with any complimentary images.

As such all primary caregivers involved with the portrait shoot must be present at the time of the show and tell presentation.
Terms & Conditions regarding Purchasing Extra Images.

All orders are to be paid in full within 3 days of this agreement unless otherwise arranged. Because all orders are customised, products are personalised and non-generic, and because the order will be processed immediately after the presentation orders cannot be cancelled or reversed. Although orders will be processed, the products will not be released to the client until all payments have been made.

We will guarantee the products against manufacturer's defect. All photographic works are copyright to Duo Photography Ltd but are released for personal use only to the client.
Terms & Conditions regarding Duo Photography Layby Sale Agreement
Our Layby Plan is a great way to pay off your investment for those treasured photographic family memories.
NOTE: this plan is not a Consumer Credit Contract as defined by the Credit Contracts and Consumer Finance Act 2003 (CCFA) or a Layby Sale as defined by the Fair Trading Act 1986 (FTA).

This Layby Sales Agreement is made between the customer and Duo Photography Ltd ("Duo") for the supply of photographic works.
-
The minimum total purchase price for eligibility for this agreement is $500.00.
-
No interest will be charged on the total purchase price of the goods.
-
The customer may request a statement showing the balance owing to Duo, which will be provided free of charge.
-
The customer must provide an initial payment of 20% of the total purchase price of the goods within 3 days of the signing of this agreement unless otherwise agreed in writing.
-
Payments pursuant to this agreement are to be made either weekly, fortnightly or monthly for a period of up to 12 months.

Duo will guarantee the product against any manufacturer's defect.

The goods will not be released to the customer until all payments have been made pursuant to this agreement.

All photographic works are copyright to Duo. Duo retains ownership of copyright but releases the photographs for personal use only to the customer.

The client has the right to cancel this agreement at any time prior to taking possession of the goods.

In the event that the customer cancels this agreement, or the customer fails to make payments at the frequency and amount as required by this agreement, or otherwise breaches a material term of the agreement, Duo will:
-
refund the amount already paid by the customer; and
-
charge a cancellation fee, calculated based on the reasonable costs incurred resulting directly from this agreement ("the cancellation fee")

The cancellation fee is calculated on the basis of compensating Duo for labour expended in processing the order and in the post production process. It also reimburses Duo for material utilised. Duo will consider the cost incurred in respect of each order but for guidance, can advise the estimate average cost associated with cancelled orders to approximately $400.00.

The cancellation fee may be deducted from the amount already paid by the customer. If the amount already paid is insufficient to cover the cancellation fee, then the balance will be recovered from the customer as a debt. Duo may take action to recover the cancellation fee and may add the cost of that recovery, including but not limited to collection fees, to the cancellation fee, By executing this agreement the customer consents to Duo providing their information to a third party credit agency in the event of default.

Photoshoots won through this competition must take place between Monday 27th December and Wednesday 5th Jan and are only available Mon-Weds.
